Anniversary, birth and death

Well our new site - Fresh Flowers and Gifts - has been live for just under a week. We have been catalogued by Google and pages are starting to rank.

We have had a number of customers now, even a lady from The Isle of Skye in the UK.

Things are a little different talking to these people. Rental Agreements DIY Australia clients are fairly unemotional as they are just looking to get a residential or commercial lease or some other legal document.

But people buying flowers - well that's a different story entirely.

When people send flowers to someone it is all about emotion.

We had Richard send his wife a bunch of roses. She was in the maternity ward with their brand new freshly hatched one day old baby. He wanted the flowers to arrive before he did so his beautiful wife and baby would know he was thinking of them. He was bubbly and excited. It was a joy to speak with him. He left me with a good feeling all afternoon. When I told my wife about it she got all clucky.

Then Cathy from the UK wanted to send her brother and sister in law a flower bouquet to celebrate their wedding anniversary. We got chatting and it was just a little sad as Cathy had been in the UK for a while and had not seen her brother for a few years. Talking to her made me think about my brother and how I tend to take him for granted.

Then there was Ultima. Her brother in law had just died. You could just hear the pain she was feeling for her widowed sister. She wanted to give her a big hug but they were on opposite sides of the world. She was very specific in the colour and arrangement of the flowers to be delivered. She was pouring her emotions into those flowers and sending them across the world.

My thoughts went to those close friends and relative I have lost over the years.

I have been involved in sales for years. Sales people are told to try to put emotion into their sales presentations. The idea is to get someone emotionally involved in the product you are selling. So you work hard to get people excited about your particular widget. However, I have never been involved in products where there is real emotion. I can try to bring in emotion with ideas about security for your family into my legal document products but it is drawing a long bow, isn't it.

Selling flowers has nothing to do with plants and foliage and wrapping paper. It's about the transfer of feelings from sender to receiver.

It has been an interesting and emotional first week.

There are many who would be surprised I have a heart at all. I suppose it surprises me a bit too.

Assignment of Lease Agreement Contract

Old Herb and a pile of dollars

I had a call from Herb a few nights ago. He had that great sounding Queensland country drawl.

Herb is 73 years old. He was ringing about our Commercial Property Lease Agreement. He had sold his business as a going concern and kept the property to get the continuing income from the rent. I imagine this is a retirement strategy for many small business owners.

It was fairly late Saturday evening when he rang. He said, "I didn't think anyone would be there".

Old Herb started to tell me about how he has just sold his business and let the people move in without organising a lease agreement for the premises. He wasn't concerned about it but the buyers of the business, quite rightly, wanted an agreement in place.

The new owners of the business need to be severely scolded for taking such a huge risk. Their enthusiasm to get started on their business empire has left them extremely vulnerable.

What if old Herb got lucky last night?

He is probably sitting on a nice pile of cash from the business. The word would have gone round the local Country Women's Association that Herb suddenly looks better than he has for years. It is highly likely Herb is being targeted by a bevy of blue-rinse sirens. That sound you hear is fan forced ovens pumping out pumpkin scones and lamingtons. Herb could be in for an exhausting couple of months.

He already told me he had heart palpitations when his solicitor told him it would be around $900 to draw up a commercial lease.

If Herb dies with a smile on his face before the lease is organised, the new business owners could be in all sorts of trouble. Whoever inherits may want to bulldoze the property and being Queensland, will probably put in a canal development.

If the business is successful because of its location, that may be the end of things. Sure they can getting involved in legal action but what a waste of energy.

The purchaser of the business should have looked at our Sale of Business Kit before handing over any money to Herb. Just by looking at the page and seeing the list of contracts included in the kit you get an overview of what to be aware of and some questions to ask the seller.

Are some tenants too much hard work?

You may have seen my page on Tenancy Laws in Australia. It summarises the various rules relating to residential tenancy. It has become a very popular page on the Rental Agreements DIY Australia website.

Both landlords and tenants use the page for reference and occasionally ring or email me with some kind of query relating to their rental situation. We are not legal advisors so I refer them to the relevant state or territory authority. Some want to tell me their story anyway, just to vent about their problems.

I got my first abusive email in a year last night. The complaint was about me saying "Sometimes you just want the current tenant out because they are too much hard work." The person, a tenant with some landlord repair issues, let me have it. He suggested I was immoral for putting that text on my webpage. He said it impacted him because landlords can kick tenants out for complaining. He certainly took what I said personally.

The offending quote is from our Ending a Residential Tenancy page. It gives some information about ending Australian tenancies and there is a little bit of practical advice for landlords about the process.

He must be a fine judge of character as all the descriptive terms he used for me I have heard often before. In fact, if he needs some support I can give him a list of people who will agree with him. For the record my parents were married.

Had a chat with my darling wife to tell her I had been abused. She gave me a hug and a pat on the head to make me feel better.

We then started to reminisce about some of the more memorable tenants we have had over the years. It did not take us long to reinforce the statement that some tenants ARE definitely too much hard work. Read our "Killer Door Death Squadron" article for one example of too much hard work. Thankfully there were not too many stories like this. Most of our tenants have been great.

Rental increases for Australian Residential Property

We have been getting a lot of questions lately about rent increases from both landlords and tenants. I suppose it is a sign of the times.

Just for you we have compiled a summary of rental increase rules for each state and territory in Australia. This information has been obtained by visiting each state govt website responsible for residential tenancy. I can't begin to tell you how exciting that was. My mind went numb by the time I had visited the 3rd one so we cannot guarantee the accuracy of the information. That is just a way to throw in a disclaimer as we did double check things.

Rental Increases

South Australia, Tasmania, Victoria, Western Australia
Ability to increase rent during tenancy only if specified in tenancy agreement.
No sooner than 6 months from start of tenancy or date of last increase.
60 days notice of increase

Australian Capital Territory
Not in first 12 months then only once per year for existing tenant.
8 weeks notice.

New South Wales
Ability to increase rent during tenancy only if specified in tenancy agreement.
No increase during fixed term.
60 days notice outside of fixed term.

Northern Territory
Ability to increase rent during tenancy only if specified in tenancy agreement.
No sooner than 6 months from start of tenancy or date of last increase.
30 days notice of increase

Queensland
Ability to increase rent during tenancy only if specified in tenancy agreement.
1 month notice.

Living together relationship agreements

It is very cold in Sydney this morning. I am thankful I am in a relationship with many benefits including someone to snuggle up to on cold winter nights like spoons in a kitchen draw.

My slave wife and I have been together forever. If I ever unchain her from the sink she might realise I was not the best catch. Thankfully the locks are industrial strength.

We both came into this relationship with nothing more than love and lust. Over the years we have added children, grandchildren and property.

If she woke up to herself and traded up to a newer model she would be wise to protect her assets from the next man pig she meets. Whether she marries or just lives with someone she should have a cohabitation agreement in place to ensure her property, jewellery, family heirlooms and other assets are protected.

And I will be looking for a new bed warmer as well. It is appropriate I get some new trophy wife. There is nothing more proper than an aged gentleman parading his barely post pubescent woman to his mates.

My wife assures me I would be lucky to get my fishing rod and reel in the event of a breakup. I do love that reel. So I also would want to protect this highly prized asset from the hands of the new and many women in my life.
